Probation & Parole is responsible for preparation of a presentence investigative report that is prepared by a presentence investigator. A presentence investigative report details information about a defendant that has not yet been sentenced for his or her crime by the court. Each presentence investigator across the state averages approximately 10-12 investigations per month.

Presentence Investigations

The presentence investigation consists of an interview with the defendant regarding a review of his or her criminal record, a review of the specific facts of the crime and a social history regarding education, employment, physical/mental health and community support systems. The presentence investigative report includes a victim impact statement and information gathered from collateral contacts. The presentence investigative report is a protected, confidential document disclosable only to the judge, prosecuting attorney, defense counsel and the defendant.

The presentence investigation and any court-ordered evaluations are in addition to any other requirements, such as any pretrial monitoring or other current supervision.

If a PSI was ordered in your case, it must be completed prior to sentencing. The purpose of the PSI is to give your sentencing judge information concerning your history and background to help the judge determine a fair and just sentence. The PSI is a Court Order; therefore, if you fail to complete the questionnaire or interview, the Court will be notified, which could result in a warrant or revocation of your bond. It is your responsibility to complete the Request and Consent for Release of Confidential Information (ROI), Personal History Questionnaire, presentence interview, and all other court-ordered assessments.

Unless your case is in Nez Perce County (if so, see below*), all out of custody defendants must check-in at the Presentence Investigation office for their judicial district immediately following court. If you were in custody but bonded out of jail prior to meeting with an IDOC staff member, check-in at the Presentence Investigation office immediately following your release. You may have received the necessary documentation while you were at court; otherwise, a copy will be provided to you when you check in. Your completed questionnaire and Request and Consent for Release of Confidential Information (ROI) form are to be submitted to the Presentence Investigation office within one week of the date you went to court. If your case is in District 2, bring the questionnaire with you to the scheduled interview instead.

*Nez Perce County defendants: a Presentence Investigator will attend your Change of Plea hearing, gather information from you, and provide you with a copy of the necessary paperwork.

The Personal History Questionnaire (English and Spanish), File Review Questionnaire, and ROI (English and Spanish) are available in the PSI FORMS section if you need a copy of the documents. An example of how to fill out the ROI is also provided.

How to complete the questionnaire

You must complete the questionnaire in full. You may use extra pages if necessary. If someone helps you complete it, they must also sign and date it. Do not leave out information or give false information, either in writing or during your interview, as such action will be brought to the attention of your sentencing judge. Please write clearly!

How to complete the ROI

Section 1 – Fill out completely (unless you do not know your IDOC #)

Section 2 – Initial next to each small line which apply to you, leave the line next to “including” blank

Section 3 – Sign and date

Most Orders for PSI require the defendant to participate in an interview with their presentence investigator. The interview will typically take between one and two hours. Make arrangements for transportation and childcare as appropriate. If you attend the interview in person, do not bring children, backpacks, purses, hats, cell phones, weapons, or explosives with you. Others should not be present for the interview unless approved by your investigator in advance.

Participate in and complete in a timely manner any other assessments/evaluations ordered by your judge. Those assessments may be a substance abuse assessment, mental health assessment, Idaho Standard Mental Health Assessment, Psychological Evaluation, Domestic Violence Evaluation, Psychosexual Evaluation, or a Stalking Evaluation.

If you reside out of the state of Idaho, you can complete a comprehensive drug and alcohol assessment that encompasses mental health through a provider in your state, and you will need to make sure your PSI Investigator receives a copy of the assessment. Otherwise, you could return to Idaho to complete the SUD assessment either by district SUD staff or a community provider at no cost to you. Please let your investigator know as soon as possible if you would like to complete the SUD assessment in Idaho so it can be scheduled. You can also speak to your attorney about asking to have the SUD assessment waived. It is imperative you choose an option early on and follow through.

Collect and provide to your investigator, if applicable:

  1. Copy of your two most recent pay stubs (if you are employed)
  2. Copy of certificates of training/educational accomplishments (such as school transcripts/certificates)
  3. Physical/mental health records or letters from doctors/hospital
  4. Copy of Certificates of Completion (such as completed treatment or classes)
  5. Letters of character reference (from companions, family, employer, coworkers, etc.)
  6. Military records, such as DD-214
  7. Social Security confirmation letter

Please be aware, if you reside out of the state of Idaho, you will need to apply for an Interstate Compact Agreement with the state where you live. A $100 fee must be paid before the transfer is submitted and before you leave the state of Idaho following sentencing.
